Conferentie: “Het sociaal verweer tegen de staatsalmacht. Historische reflecties - La société civile comme contrepoids de l’Etat. Une réflexion historique”

La Fondation Arenberg veut attirer l’attention sur l’histoire commune des peuples européens. Le jury a considéré que mon livre répondait à cet objectif, et je m’en réjouis. En effet, j’ai délibérément choisi une approche européenne pour la thématique que je voulais aborder. Concrètement, je souhaitais montrer qu’un ordre politique similaire avait été mis en place sur le continent européen entre 1815 et 1965. Mon étude se concentre surtout sur la formation de l’État moderne et plus précisément sur la définition de ses tâches et de son impact social. Elle explique comment le pouvoir illimité de l’État a progressivement été bridé, non seulement à travers l’introduction d’un statut juridique garanti aux citoyens individuels, mais aussi grâce à une « société civile » solidement structurée. Mon ouvrage s’intéresse surtout à ce dernier aspect, c.a.d. au rôle du ‘tissu social’ en tant que contre-pouvoir de l’Etat. D’où le titre de mon exposé.

Since the time when Thomas Hobbes published his famous treatise Leviathan, in 1651, this awesome sea monster from the Biblical book Job has symbolized the omnipotence of the State. Hobbes, deeply worried by the chaos and anarchy afflicting the English society during a protracted civil war, advocated an absolute power of the State, which should extend across all domains of human life. The sovereign was not only the highest political authority, he also defined what was good and evil. New in Hobbes’ thought was that he did not trace back the absolute power of the sovereign to a form of Divine right, but to a social contract among individual citizens who, in an attempt to escape from anarchy, accepted an absolute subservience to the monarch, in exchange for protection, safety and peace. In this way Hobbes created a powerful, future-oriented foundation for the principle of state sovereignty.

John Locke (1632-1704) ‘liberalized’ Hobbes’ contract theory. In his view the citizens, when concluding the social contract, did not transfer all their rights to the State. The government should respect their lives and properties and facilitate their self-development. In this way Locke limited the power of the State. In fact, he was the first theoretician who strongly emphasised the protection of individual rights. He can therefore be seen as the founder of political liberalism. His ideas were further developed and spread by French theoriticians such as Montesquieu and Rousseau. This was not without importance, as French culture was trend-setting in Europe in those days.

Le libéralisme s’opposa au pouvoir établi des souverains absolus et des élites traditionnelles. Dans la construction de l’édifice social, il accorda une place centrale à l’individu fort et entreprenant. Autant que possible, celui-ci devait être débarrassé de contraintes religieuses, politiques et sociales et bénéficier de larges possibilités de déploiement. Le libéralisme développa donc un système dans lequel l’État laissait beaucoup d’espace aux citoyens en tant qu’individus, en respectant leur libertés inaliénables. Il s’agissait aussi bien de libertés civiles, regroupées autour du principe de la liberté d’opinion, que de droits politiques, comme le droit de pétition ou le droit de suffrage. Les droits politiques reposaient sur l’idée de la souveraineté populaire, qui trouvait son expression pratique dans un régime parlementaire représentatif. Dans les États libéraux, les droits fondamentaux étaient en outre généralement garantis par une division du pouvoir, plus précisément par une séparation entre les pouvoirs exécutifs, législatifs et judiciaires, un concept principalement emprunté à Montesquieu. De cette manière, les libéraux développèrent une stratégie marquée pour endiguer le pouvoir de l’État, symbolisé par le Léviathan.

Tout cela n’ empêchait pas que les libéraux pouvaient être qualifiés comme des « étatistes ». En effet, ils considéraient l’État comme une organisation ‘obligatoire’, un pouvoir souverain et intemporel, auquel chacun devait obéissance. A leurs yeux, l’État était l’unique source de droit et de législation et ses compétences s’étendaient en principe à tous les domaines de la vie politique et sociale. Dans tous ces domaines ses tâches et son impact ne pouvaient être limités que par le statut juridique des citoyens individuels. Les libéraux restaient donc partisans d’un pouvoir étatique fort et universel, à condition que celui-ci repose sur la volonté du peuple. Cette position avait surtout été développé par Rousseau, chantre par excellence de la souveraineté populaire. Rousseau n’avait pas d’objection contre une concentration et une centralisation du pouvoir de l’État pour peu qu’il repose dans les mains du peuple et traduise la « volonté générale ». Cette tendance « républicaine » allait exercer une forte influence sur les libéraux au cours du 19e siècle. Elle rejoignait d’anciennes traditions bureaucratiques et centralistes, visant à renforcer le pouvoir de l’État. Elle comportait toutefois une menace pour les droits des minorités et elle risquait de renforcer l’impact de l’État sur la vie des individus, qui étaient insuffisamment armés pour offrir une résistance efficace contre lui. Montesquieu avait déjà mis en garde contre ce danger. Je cite: « On ne doit pas confondre le pouvoir du peuple avec la liberté du peuple. » Néanmoins, à partir de la seconde moitié du XIXe siècle, l’État-Nation uni et centralisé deviendrait l’incarnation la plus typique d’un tel étatisme libéral, largement inspiré par Rousseau et fixant des limites claires à la restriction du pouvoir de l’État.

Het liberale ideeëngoed werd uit alle macht bestreden door conservatieve – niet zelden aristocratische - kringen, die na 1848 steeds meer in het defensief gedrongen werden. De conservatieven kantten zich tegen de abstracte liberale theorieën, die de oorsprong van de Staat terugvoerden op een voorondersteld sociaal contract tussen individuele burgers. Zij waren van mening dat de samenleving niet zozeer op individuen steunde, maar op natuurlijke groepen, zoals familieverbanden, lokale gemeenschappen, stands- of beroepsorganisaties en kerkgenootschappen. Die kwamen historisch en ontologisch vóor de Staat kwamen en konden een grote autonomie claimen. De Staat was wel de hoogste gezagsinstantie in de politieke sfeer, maar hij moest rekening houden met de sociale structuren, die de burgers omkaderden en beschermden. Hij moest de wettelijke status van die sociale verbanden regelen en hun vrije ontwikkeling waarborgen. Een sterk ‘sociaal weefsel’ zou ertoe bijdragen de vrijheid van de burgers te beschermen en tegelijk fungeren als een verweermiddel tegen een despotische Staat. Een analoge gedachtengang was reeds in de 18e eeuw ontwikkeld door de reeds meermaals geciteerde Montesquieu, die van mening was dat de samenleving zo moest georganiseerd worden dat de centrale regering voortdurend geconfronteerd werd met barrières die haar machtsuitoefening aan banden legden. Een eeuw later wees Alexis de Tocqueville er op dat de staatsmacht in een genivelleerde, geatomiseerde samenleving mee moest bedwongen worden door aangepaste intermediaire structuren en associaties.

Het is niet verwonderlijk dat veel aristocraten ernaar streefden om een sociale buffer op te werpen tegen de staatsmacht. Zij pleitten voor het behoud van de traditionele, historisch gegroeide structuren, waarin zij een sterke machtspositie bezaten. Zij gaven echter niet meer dan de liberale burgerij blijk van een onmiskenbare klassereflex. De bourgeoisie wilde immers via een gecentraliseerde, parlementaire staat - met een beperkt stemrecht – op haar beurt haar eigen hegemonie vestigen. Conservatieve tegenstanders van het staatscentralisme vonden een machtige bondgenoot in de katholieke Kerk, die in de negentiende eeuw een reveil beleefde en met kracht haar onafhankelijkheid en haar maatschappelijke invloed verdedigde. Conservatieve en kerkelijke kringen zouden er samen naar streven via een ‘sociale strategie’ de staatsmacht aan banden te leggen.

Diese politisch-philosophische Darlegung ‘über die liberalen und insbesondere die sozialen Strategien’, die im Hinblick auf die Eindämmung der Staatsmacht entwickelt wurden, weist einen verhältnismäßig hohen Abstraktionsgrad auf. Ich habe mich jedoch bemüht, sie in der Gestalt einer ‘Geschichte von Menschen’ in meinem Buch einem breiten Publikum zugänglich zu machen. In dieser Geschichte werden prominente Staatsleute wie Metternich, Bismarck und Adenauer aufgeführt, aber auch Päpste wie Pius IX., Leo XIII., und die kardinäle Gaspar Mermillod und Wladimir Czacki ‚Salonlöwinnen‘ wie die russische Prinzessin Ekatarina Bagration und die polnische Diva Maria Kalergis, Geschäftsleute wie der niederländische Bankier Willem Cramer und der belgische industrielle Joseph de Hemptinne, Sozialreformer wie die Österreicher Alois von Liechtenstein, Karl von Vogelsang und die Franzosen René de la Tour du Pin und Albert de Mun. Im Rampenlicht steht jedoch der österreichische Spitzendiplomat Gustav von Blome, ein norddeutscher Aristokrat aus Holstein, natürlicher Enkel und Schützling des österreichischen Kanzlers Metternich und erklärter Gegner Bismarcks. Sowohl in diplomatischer, religiöser als auch sozialer Hinsicht spielte er auf der internationalen Szene eine bedeutungsvolle Rolle. Nach seinem Tod kennzeichnete ihn Alcide de Gasperi, der Grundleger des modernen Italien, mit Recht als ‘un bel tipo d’europeo’. Paul Vasili erwähnte ihn in seinem weit verbreiteten Buch La société de Vienne (1885) als den hochgebildetsten und entwickeltsten Aristokraten der österreichisch-ungarischen Doppelmonarchie. In den Worten La Tour du Pins war er ‘un conducteur d’hommes, au suprême degré’. Zu gleicher Zeit war er eine scharfsinnige Persönlichkeit, die dem Zeitgeist entgegenwirkte, in vielerlei Hinsicht jedoch auch die Zukunft vorbereitete.

The ‘social strategy’ applied against the power of the State, had ramifications in the political and religious spheres, as well as in the social field. Blome was active in all those domains, but he was in the first place a diplomat and a statesman. In the political sphere (at first) conservatives like Blome distinguished multiple layers in the political construction, from a regional to the international level. Out of respect for the local communities they advocated decentralization and federalism. At the same time, they were strongly in favour of a supranational cooperation. That’s why they were adhering to the so-called ‘European Concert’, which was set up after the Napoleonic wars, with Metternich as figurehead. In this system the superpowers acknowledged the ultimate subordination of their national interests to a supranational aim, namely establishing and maintaining peace and security in Europe. They wanted to replace war and violence by a universally accepted legal system aimed at solving conflicts through diplomatic consultations. For that purpose they initiated modern conference diplomacy.

The ‘European Concert’ had a praiseworthy objective, but in practice it mainly served the interests of the established powers. Therefore it came more and more under the attack of liberal and nationalistic movements. Bismarck would use those tendencies to expand the power of Prussia in the setting of German unification. He forged an alliance between conservatism and nationalism. Gradually the nation state would become the principal actor in international politics. There was a growing conviction that the interests of the national states prevailed over the international legal order and that it was wiser for them to rely on their military power than on the provisions of treaties. The sense of a supranational interest, the pursuit of a long-lasting peace, almost completely disappeared. As a diplomat in the Austrian service, Blome was a privileged witness of this turning point in international politics. He revealed himself as an important antipode of Bismarck and his militaristic and nationalistic policies. In 1865 he negotiated with him the Convention of Gastein in an ultimate attempt to forestall war between Prussia en Austria. His opposition to the reversal in international politics turned out to be in vain. From his grandfather and protector Metternich Blome had learned, however, “qu’il faut se mettre en panne” if you are not in a position to adjust an unfavourable situation. Therefore he resigned as a diplomat in 1868 at the peak of his career.   

As said, Bismarck realized an alliance with nationalism and came to compromises with the national Liberals in Germany. Blome on his side was to set his hopes on the Catholic Church in order to achieve a stable social order in Europe. Zoals veel andere conservatieven functionaliseerde hij de religie en waardeerde hij haar vooral om haar sociaal integratievermogen. Van huize uit was hij Lutheraan, maar hij bekeerde zich tot de katholieke Kerk, waarin hij een belangrijke stabiliserende factor zag. Hij verwachtte tevens van haar dat zij een tegengewicht zou vormen tegen de groeiende macht van de gecentraliseerde natiestaat. De supranationale katholieke Kerk had inderdaad van oudsher met klem haar autonomie tegenover het staatsgezag verdedigd. Dat werd nog meer het geval na de Franse revolutie, toen steeds meer staten zich kerkvijandig gingen opstellen. Een opmerkelijk religieus reveil gaf aan de katholieke Kerk het draagvlak en tegelijk de daadkracht om haar werkingssfeer en haar autonomie te verdedigen tegenover liberale regeringen, die haar aan banden wilden liggen en haar maatschappelijke invloed wilden terugdringen. Dat proces leidde tot een versterking van haar kaders en vooral van het pauselijk gezag, wat zijn culminatiepunt vond in de proclamatie van de pauselijke onfeilbaarheid in 1870.

In den 1870er Jahren kam es zu einer richtigen Kräftemessung zwischen dem modernen Staat und der katholischen Kirche, die ihre Unabhängigkeit und ihren traditionellen Einflussbereich sichern wollte. Auf liberaler Seite entwickelte sich eine radikale Tendenz, die eine Art von ‚Staatsabsolutimus‘ verkündete. Nach dieser Auffassung  könne nur der Staat, in seinen Ansprüchen allumfassend, für Gerechtigkeit, Sicherheit und Frieden einstehen. Eine der wesentlichen Aufgaben dieses Staates sei es, das Individuum geistig zu befreien und das dazu erforderliche Rahmenwerk zu schaffen. Die Radikalliberalen duldeten nicht, dass Kirchen oder andere Mittelmächte dieses Bemühen konterkarierten. Im Hinblick auf die Verwirklichung ihrer Zielsetzungen waren sie dazu bereit, Staatszwang zur Anwendung kommen zu lassen, vor allem gegen die katholische Kirche, die in ihren Augen die größte Gegenmacht und Bedrohung für die Emanzipation des Individuums darstellte. So kam es zu einer richtigen Offensive gegen die katholische Kirche, die als antimodernistische Institution gebrandmarkt wurde. Gegen sie wurde ein ‘Kulturkampf’ geführt, vor allem in Ländern, in denen sich der zentralisierte Nationalstaat mit säkularisierten Zeitströmungen im Gleichklang befand. Dieser ‘Kulturkampf’ tobte vor allem in Deutschland, wo der ‘Staatskonservative’ Bismarck sich mit den Nationalliberalen zusammentat, dehnte sich jedoch ebenfalls auf die Nachbarländer aus. Die Konfrontation führte dazu, dass die katholische Kirche zwar einiges Terrain aufgeben musste, es ihr jedoch im Wesentlichen gelang, ihre Autonomie zu sichern. Dank der erfolgreichen Mobilmachung ihrer Anhänger versicherte sie sich einer breiten Unterstützung, die es ihr erlaubte, ihre Eigenständigkeit sowie ihren gesellschaftlichen Einfluss aufrecht zu erhalten.

In this episode Blome played a significant role. Afther his diplomatic career he put himself in the service of the Holy See and became the pivotal figure of the ‘Black International’, a secret lay organisation mobilizing the Catholic masses in Europe in order to defend the autonomy and the international statute of the Holy See. The history of this Black International reads like a real detective story, but more importantly it shows us how the Catholic Church succeeded in transforming Catholic public opinion into her main defence line, through the application of modern techniques of mobilization.

Dans un réflexe d’autodéfense, l’Église catholique s’était donc tournée vers le peuple. En partie grâce à cela, elle avait acquis une meilleure compréhension  des besoins matériels des classes populaires. Fait remarquable, on vit se développer jusque dans des cercles aristocratiques un réformisme social (Sozialreform), qui luttait contre les dérives du capitalisme et qui voulait, au moyen de réformes structurelles corporatistes, instaurer un système social plus juste. Blome fut dans les années 1880 un représentant important de cette tendance. Il fut en effet le fer de lance de l’Union de Fribourg, un cercle international de réflexion qui allait, en concertation avec le Saint-Siège, donner l’amorce au développement d’un système social, visant à créer une société solidaire et harmonieuse. Selon les membres de cette Union, les problèmes sociaux des ouvriers et des paysans devaient - avant tout - être remédiés au moyen de la vie associative et, accessoirement, de l’intervention sociale de l’État. Ils étaient en principe opposés à un pouvoir trop fort de l’Etat, mais ils estimaient qu celui-ci était, dans l’attente du rétablissement des forces sociales, appelé à rétablir une société plus juste et solidaire. Les associations ouvrières et professionnelles devaient quant à elles assurer un contrepoids bénéfique contre l’Etat. Elles assumeraient de larges compétences dans la sphère socio-économique et exerceraient un contrôle sur l’État par le biais d’ une forme de représentation politique des groupes d’intérêt. Blome contribua largement à l’élaboration de ces conceptions corporatistes, mais il les formulait d’une façon remarquablement flexible et pragmatique, en tenant compte dans une large mesure de la réalité sociale. Cette souplesse d’attitude lui valut de devenir une figure charnière entre les aristocrates sociaux et la démocratie chrétienne du 20ième siècle.

L’Union de Fribourg influença incontestablement la doctrine sociale de l’Église catholique, dont l’encyclique Rerum Novarum (1891) de Léon XIII allait être la première traduction cohérente. Deze encycliek reageerde tegen de uitwassen van het liberaal kapitalisme en hield voor dat het rechtvaardigheidsbeginsel aan de basis moest liggen van de maatschappelijke ordening. De arbeiders hadden recht op een behoorlijk, rechtvaardig loon en menswaardige werkomstandigheden. Zij moesten zich kunnen organiseren in beroepsverenigingen om hun belangen te verdedigen, niet in een sfeer van klassenstrijd maar van klassensamenwerking. De beroepsorganisaties moesten een hoofdrol spelen in de oplossing van de sociale tegenstellingen. De Staat had slechts in tweede orde een taak te vervullen. De natuurlijke sociale verbanden kwamen immers historisch en ontologisch vóór de Staat en legden beperkingen op aan zijn rol en zijn opdracht. De Staat was er voor de burgers en hun sociale verbanden en niet omgekeerd. In de sociale leer, die door Rerum Novarum ontwikkeld werd, werd duidelijk gekozen voor een samenlevingsopbouw van onderuit. In dat opzicht bevatte zij de kiemen van het moderne subsidiariteitsbeginsel. De sociale leer van de katholieke Kerk zou de christelijke volksorganisaties inspireren, die in de loop van de 20e eeuw op een betekenisvolle manier zouden bijdragen tot een versterking van het sociaal weefsel. Uiteraard zou ook de sociaal-democratie daar – zelfs in nog grotere mate – een aandeel in hebben, maar zij zou zich veel meer ‘etatistisch’ opstellen dan de christelijke volksbewegingen.

Blome war somit bestrebt, sowohl in der politischen als auch in der religiösen und sozialen Sphäre gegen die Staatsmacht Schranken zu bilden. Seine Bemühungen führten freilich nicht sofort zu den verhofften Ergebnissen, aber auf die längere Frist sollten sich doch einige seiner Ideen als fruchtbar erweisen. 1871 veröffentlichte er eine viel beachtete Broschüre Wo ist Europa’s Zukunft. Obwohl die Veröffentlichung von Zeitgenossen als reaktionär empfunden wurde, waren manche Ideen doch zukunftsträchtig. In seinem Text formulierte Blome den Traum von einer europäischen Gesellschaft, in der ethische Grundsätze sowohl die internationale als auch die nationale Politik bestimmen sollten und die Staatsmacht eingeschränkt, die freie Wirkung der Kirche gewährleistet sowie der Schutzwirkung sozialer Verbände Vorschub geleistet werden sollte.

Several of Blome’s aspirations were realized, mainly thanks to Christian Democracy, which after World War II acquired a powerful position in the core countries of the actual European Union.

Firstly. In the political sphere the sense of a supranational interest revived. Via the process of European integration an international system was established that transcended nationalism and was based on ethical principles. This integration process led to a long-lasting peace, as was recently highlighted, when the Nobel Peace Prize was awarded to the European Union. Moreover, the principle of subsidiarity received an important application in the European construction, to be sure more in a political-territorial than in a socio-functional sense. Anyway the idea prevailed that society had to be built bottom-up. At the same time there was more room for decentralization and federal constructions.

Secondly. In the religious sphere the post-war climate of freedom benefited the churches, whose rights and freedoms were henceforth explicitly guaranteed by new constitutions in Italy, the German Federal Republic and France. More than before, religious and socio-cultural organizations had the opportunity to develop freely.

Thirdly. In the social sphere Christian-Democrats, inspired by ‘neocorporative’ formulas, where shaping so-called ‘social capitalism’. They strove to combine the free market with social justice, to be realized in an harmonious cooperation between the State and differents types of social organizations. In various countries occupational associations acquired important socio-economical competences and became involved in the political decision-making process. Together with the government they shaped an economy based on consultation, with the intention to promote social harmony.

À long terme, la stratégie sociale, développée pour brider le pouvoir de l’État, porta donc ses fruits. Bien sûr, elle ne sut pas prévenir la montée de régimes totalitaires/fascistes pendant l’entre-deux-guerres, mais elle fournit des idées et des structures à la formation de la société européenne d’après-guerre. Néanmoins, on ne peut pas prétendre que dans cette nouvelle Europe, le Léviathan fut maîtrisé exclusivement par le tissu social ou la société civile organisée. La stratégie « libérale » eut aussi une part importante dans ce processus. Elle s’était également avérée incapable de contrer le fascisme, mais après la Seconde Guerre mondiale, l’État de droit constitutionnel et libéral allait connaître un renouveau en réaction au totalitarisme tant communiste que fasciste. La forte influence conquise par les États-Unis sur le vieux continent  contribua également à la renaissance du système libéral. Dorénavant, les principes constitutionnels libéraux étaient partagés par les autres tendances démocratiques. Elles aussi attendaient que l’Etat garantisse avec fermeté les droits et libertés inaliénables de ses sujets. Les stratégies libérales et sociales, destinées à endiguer le pouvoir de l’État, qui s’étaient initialement développées dans des directions opposées, s’entrelacèrent finalement pour donner forme à la société européenne d’après-guerre. Ainsi, le pouvoir de l’État était limité à présent non seulement par le tissu social, mais aussi par le statut juridique des individus, ainsi que l’avaient voulu les libéraux. Dans mon livre, cet entrelacement des stratégies libérales et sociales est mis en lumière par une esquisse de la politique de Konrad Adenauer, qui entre en scène dans l’épologue.

Perhaps this ‘European’ story also holds a lesson for developments elsewhere in the world. It can be a source of inspiration for countries willing to achieve a transition from an authoritarian to a democratic form of government. Practice shows that a liberal strategy – granting a guaranteed legal status to the citizens and the organization of popular participation through elections – does not always suffice to stem the omnipotence of the State. Also the social fabric, the ‘civil society’ has to be strengthened, because it can offer the citizens an additional protection and a counterbalance against an excessive power of the State.
